Petitioners seek concession of pre-arrest bail in a case registered against them under sections 306 IPC vide FIR No. 12 dated 26.01.2018 at police station Rahon, Tehsil Nawanshahar, district Shaheed Bhagat Singh Nagar. It has been urged before the court that petitioners have been falsely implicated in the case. There is nothing on record to connect them with the commission of crime. They are, thus, entitled to concession of pre-arrest bail. Learned State counsel has opposed the prayer. According to them, custodial interrogation of the petitioners is required for taking the investigation to its logical end.
FIR was lodged on the basis of statement of Rajan who was working as a painter. He alleged that on 25.01.2018 at about 9.00 p.m. he and his father were sleeping in the room. At about 10.00 p.m. his younger brother Boota Ram (deceased) came to them and told that Gagandeep @ Bunty and Sandeep @ Anshu (petitioners herein) have beaten, abused and Ajay Kumar 2018.03.07 16:38 I attest to the accuracy and authenticity of this document
CRM M-7406 of 2018 insulted him. Thereafter, he went to another room and committed suicide. It is evident that allegations against the petitioners are serious. They are alleged to have threatened the deceased forcing him to commit suicide. Keeping in view the nature of allegations, I am of the considered view that petitioners are not entitled to concession of pre-arrest bail. Investigation has to be taken to its logical end for which custodial interrogation of the petitioners may be necessary. Dismissed.
