CRM-M No.27222 of 2020:

This is a petition under Section 482 of the Code of Criminal Procedure, 1973 seeking protection of the petitioner at the hands of the official respondents, who are alleged to be unnecessarily harassing and threatening her.

Learned counsel for the petitioner has contended that a representation was given to the Senior Superintendent of Police, Moga on 27.06.2020. However, no action has been taken thereon and the petitioner is being unnecessarily harassed.

CRM-M No.27222 of 2020 -2Vide order dated 14.09.2020, learned counsel for the petitioner had sought time to place on record the judgments whereby the son of the petitioner was acquitted in the FIRs registered against him under the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). Vide CRM-30816-2020, the learned counsel has placed on record two judgments wherein the petitioner's son stands acquitted in the FIRs registered under the NDPS Act.

Learned counsel for the State, on instructions from ASI Surjit Singh, has stated that there were a total of 13 cases registered against the son of the petitioner under the various provisions of law. In three cases the petitioner's son stands convicted, one is pending trial and in the remaining cases he stands acquitted. The learned State counsel has further stated that the representation dated 27.06.2020 has been inquired into and since filed, there being no substance therein. She, however, states that in case the petitioner is required in connection with investigation, the respondents shall follow the procedure as laid down in the Code of Criminal Procedure, 1973 and shall not violate the due procedure.

In view of the above, the present petition is disposed off with a direction to the respondents that in case they need the petitioner to join investigation in any of the cases, they shall follow the due procedure as provided in law.
