Saroj Devi-petitioner has filed this petition under Section 482 Cr.P.C. for issuance of directions to the respondent to register the FIR under Section 307/323/392/506 read with Section 34 IPC and further to hand over the investigation to CBI.

Learned counsel for the petitioner concedes that Daily Diary No.17 dated 22.04.2019 already stands recorded by police, whereby preventive measures have been taken under Sections 107/150 Cr.P.C. The proceedings are pending at Police Station Narwana, Jind. A perusal of the calendera under Sections 107/150 Cr.P.C. reveals that no cognizable offence was made out in respect of the alleged beatings on Saroj Devi (petitioner). It is clearly mentioned that the matter pertains to family dispute and arises due to petty issue in the house. CRM-M-25565-2019 (O & M) -2In view of the above, it is evident that the complaint of the petitioner-Saroj Devi is already being attended to by the Police Station Narwana and in view of the conduct of the petitioner who is not participating in the proceedings, it cannot be accepted that the police is not taking any action on the said complaint. Therefore, no ground is made out for invoking the inherent powers under Section 482 Cr.P.C. Dismissed.
