The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to grant the petitioners pay scale and allowances as per Punjab State Elementary Education (Teaching Cadre) Group C Service Rules, 2018 i.e. 10300-34800 + 4200 Grade Pay, Initial Pay : 16290, along with all allowances applicable under the 5th Punjab Pay Scale Matrix, with further revisions, in view of the judgment passed in CWP-15896-2023 titled as 'Saurabh Sharma and others v. State of Punjab and another', decided on 13.09.2024 (Annexure P-6) and instructions dated 05.01.2026 (Annexure P-1) issued by the respondent-State and for payment of arrears of salary along with interest.

Learned counsel for the petitioners submits that for redressal of their grievances, the petitioners have also served a legal notice dated 08.02.2026 (Annexure P-9) upon the respondents which is VINAY 2026.04.30 18:49 I attest to the accuracy and authenticity of this order/judgment

CWP-13146-2026 -2still pending consideration. He further submits that at this stage, the petitioners would be satisfied, if appropriate directions are issued to the respondents to consider and decide the said legal notice, by passing a speaking order, in a time bound manner.

On receipt of advance copy, Mr. Siddharth Sandhu, AAG, Punjab, accepts notice on behalf of the respondents. He has no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3 to decide the legal notice dated 08.02.2026 (Annexure P-9) submitted by the petitioners expeditiously, by passing a speaking order after affording an opportunity of hearing to them, preferably within a period of 04 months from the date of receipt of certified copy of this order. Further, the decision taken thereon shall be conveyed to the petitioners.
