Challenge in the present appeal is to order dated 29.07.2021 passed in CWP-14124-2021 by learned Single Judge, whereby claim of the appellant was dismissed.

Learned counsel for the appellant submits that present appeal may kindly be disposed of having been not pressed any further, at this stage with liberty to challenge the policy dated 10.06.2021 by which, the land in front of the house of the appellant is being allowed to be sold to the occupant. 3.

Learned counsel for the appellant further submits that as the respondent No.5 was only running the concerned khokha in front of appellant's house, in case, the Court was not inclined to accept, the order could have been passed, but without costs. Hence, the costs imposed upon the appellant may kindly be waived off.

Learned counsel for the respondent(s) raises no objection for the same.
