The prayer made in the present petition is for directing the respondents to grant to the petitioner the benefit of leave encashment in entirety in lieu of unutilized earned leave lying at his credit on the date of superannuation, rather than payment of 300 earned leaves. 2.

Learned counsel would submit that the services of the petitioner were regularized for the post of Workshop Attendant on 03.11.1982 wherefrom he had retired on 30.04.2022 and was entitled to leave encashment in entirety in lieu of unutilized earned leave lying to his credit on the date of superannuation, rather than 300 earned leaves in terms of Notification dated 30.10.2015, Annexure P-1. In this regard, a representation dated 29.07.2023, Annexure P-2, has been submitted, which has yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioner is sanguine of it being considered in a positive manner, in case, a direction is given to respondent Nos.1 and 2 to decide the same in a time bound manner by granting him an opportunity of hearing.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent Nos.1 and 2 to decide the representation dated 29.07.2023, Annexure P-2, expeditiously.
