(ORAL) Petitioners have approached this Court under Article 226 of Constitution of India seeking issuance of a writ in the nature of mandamus directing the official respondents not to harass and/or implicate the petitioners in a false case at the instance of private respondents No.4 to 15, as the petitioners are in a live in relationship.

Learned counsel for the petitioners contends that both the petitioners are major and known to each other for the last 2/3 years. Out of love affair, they wanted to marry each other, but neither the husband of petitioner No.1 nor wife of petitioner No.2 are giving divorce to them. He further contends that marriage of petitioner No.1 was solemnized with Yadwinder Singh (respondent No.10) against her will, by her biological parents i.e respondents No.4 and 7. After one month of the marriage, she came back and presently she is residing with her adoptive parents. Marriage of petitioner No.2 was solemnized with Amarjit Kaur (respondent No.13). Two children born out of the said wedlock and the children are now staying with her. Petitioner No.2 is living separately from his wife. In these circumstances, petitioners also submitted representation dated 07.09.2020 (Annexure P-3) to respondent No.2 but the same has not been adverted till date. Hence, the petition.

Taking into consideration the admitted averments contained in the petition, it is not a case warranting interference by this court under its extra ordinary constitutional jurisdiction.

Dismissed with liberty to seek alternative remedy, as may be available in law.
