The petitioners through instant petition under Article 226/227 of the Constitution of India are seeking direction to respondents No.1 & 2 not to release any amount lying in the bank account of deceased to respondent No.4-nominee or any other person. They are also seeking direction to respondents to freeze the bank account maintained with respondent-bank.

As per pleadings, the petitioners are legal heirs of the deceased (husband of petitioner No.1 and father of petitioner No.2) who expired on 21.04.2026. He had a bank account with respondent-bank bearing account No.00302010045560. They approached respondent-bank for withdrawal of balance in his account. The respondent-bank despite filing of claim by petitioners attempted to release the amount to DEEPAK BISSYAN 2026.04.30 16:52 I attest to the accuracy and integrity of this document

CWP-13207-2026 -2respondent No.4. They preferred representation dated 23.04.2026 to the respondent-bank not to release any amount to respondent or any other nominee but the same has not been addressed till date. 3.

Learned counsel for the respondent, who on advance notice is present in Court, submits that the Bank is bound to comply with instructions issued by RBI as well as rules and regulations applicable to Banks with respect to release of funds lying in the account of any person who has passed away.

The petitioners and respondent No.3 are relatives and there is dispute between them with respect to funds lying in the account of petitioner No.1's husband. This Court cannot determine rights of parties. The Bank is bound to follow applicable rules and regulations. 5.
