  The present petition has been filed under Section 483 of BNSS 2023 seeking regular bail in FIR No.17 dated 12.02.2025 under Sections 109, 115(2), 126(2), 351(2), 191(3), 190 of BNS (Section 117(2) of BNS added vide order dated 27.05.2025) registered at Police Station City-1, Sangrur, District Sangrur.

The case of the prosecution is that the complainant was given injuries by the petitioner and his co-accused. However, it is stated that the petitioner was not named in the FIR and no specific injury has been attributed to the petitioner. Moreover, grievous injuries have been attributed to Manjinder Singh and Aman Kumar, the main accused, whereby Manjinder Singh hit the complainant on his head with an iron rod and Aman Kumar, holding sword, also attacked the complainant on his head.

Learned counsel for the petitioner contends that the petitioner was not named in the FIR and no injuries have been attributed to the present petitioner. He further contends that neither he was present at the place of occurrence nor has committed any offence. I have heard learned counsel for the parties and have gone through the material placed on record.

Keeping in view the facts and circumstances of the present case, and the fact that the petitioner is in custody for the last 04 months and 26 days and also, the trial is yet to commence, and as such, further incarceration of the petitioner would not serve the ends of justice, therefore, this Court deems it a fit case to grant the concession of regular bail to the petitioner. 7.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is granted concession of regular bail in the present case, on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate/ Chief Judicial Magistrate concerned. The pending applications, if any, also stand disposed of. 8.

It is however, made clear that in case during his bail, the petitioner indulges in any offence, the State shall be at liberty to file an application for cancellation of bail of the petitioner.
