This petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the issuance of a direction upon the official respondents to conduct free and fair investigation in FIR No.95 (Annexure P-1) dated 15.11.2025 at Police Station Women, District Amritsar, registered under Section 376 of IPC, 1860 (now Section 64 of BNS, 2023).

At the very outset, learned senior counsel for the petitioner has submitted that the present FIR, registered on the statement of respondent No.3 is motivated, being a counter blast to the FIR that was got registered by the petitioner against her and another accused for allegedly embezzling an amount of Rs.1,02,93,000/- from the company of the petitioner, wherein charges were framed on 26.11.2025. It is submitted that respondent No.3, who was absconding at the time was discovered by the Investigating Agency in Dwarka, Gujarat, which after producing her before the Illaqa Magistrate and obtaining transit remand orders from the Court, brought her back. CRM-M-24340 of 2026 -2point in time were allegations levelled by her, which only subsequently surfaced after she was granted bail in the said FIR. It is submitted that a representation seeking free and fair investigation in the present FIR, emphasizing these facts, had been moved on behalf of the petitioner, on which action is yet to be taken. Learned senior counsel submits that at this stage, the petitioner would be satisfied if appropriate directions are issued to the official respondents concerned to take into account all the facts as contained in the said representation while conducting an enquiry in FIR No.95 dated 15.11.2025.

At the asking of the Court, Ms. Guramrit Kaur, DAG, Punjab accepts notice on behalf of respondents No. 1 and 2 -State and submits that the needful will be done in due course. Let a complete set of the paper-book be supplied to her during the course of the day. 5.

In view of the limited prayer made and without commenting on the merits of the case, the present petition is disposed of at this stage with a direction to respondent No. 2 to consider and decide the representation (Annexure P-7) of the petitioner expeditiously, preferably within a period of 2 months, by passing a speaking order in accordance with law. 6.

Pending miscellaneous application(s), if any, also stands disposed of.
