The present petition has been filed by the petitioner under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (for short - 'the BNSS') seeking the following relief:- i. The quashing of impugned orders dated 04.02.2025 (Annexure P-9) and 25.03.2025 (Annexure P-11) passed by learned Judicial Magistrate Ist Class, SAS Nagar, whereby the applications (Annexure P-8 and 10) seeking modification of conditions No.1 and 2, respectively imposed upon the petitioner while granting him bail, vide order dated 04.03.2020 (Annexure P-2), were dismissed. ii. Modification of order dated 04.03.2020 (Annexure P-2) to the extent:

CRM-M-26159-2025 (O&M) ( 2 ) • to allow the petitioner to withdraw the previous bail bonds in sum of Rs.10,00,00/- with one surety in the like amount and substitute and submit fresh bail bonds for a sum of Rs.1,00,000/- with one surety in the like amount;

• to allow permanent release of passport of the petitioner; and • to modify condition No.3 of bail order (Annexure P-2) and allow the petitioner to intimate the investigating officer before leave India.

After arguing for some time, learned counsel for the petitioner limited his prayer to the extent that an order similar to that of order passed by coordinate bench of this Court in a similarly situated case i.e. CRM-M26062-2025, may be passed in the present petition. The operative part of aforesaid order is reproduced as under:

"Therefore, I deem it appropriate to modify the condition No.2 to the extent that the passport shall be returned to the petitioner. However, condition No.3 that he would not leave the country without the prior permission of the Court shall remain intact. Whenever the petitioner wishes to travel, he shall take permission of the Trial Court who shall impose necessary conditions and only then would be permitted to travel abroad." 3.

Learned State counsel has opposed the prayer made by learned counsel for the petitioner.

Keeping in view the limited prayer of learned counsel for the petitioner, the present petition is disposed of in terms of order dated 28.10.2025 passed by a Coordinate Bench of this Court in CRM-M-260622025. Thus, condition No.2 is hereby modified to the extent that the passport shall be returned to the petitioner. However, condition No.3 that he would not leave the country without prior permission of the Court shall remain intact. Whenever the petitioner wishes to travel, he shall take permission of the trial court, who shall impose necessary conditions, and only then he would be permitted to travel abroad.
