A civil suit with an application for grant of temporary injunction is pending before the learned Civil Judge (Junior Division), Faridabad. This revision petition under Article 227 of the Constitution of India has been filed for setting aside the order dated 02.09.2020 (Annexure P5) whereby the adjournment has been granted. On 15.09.2020, the following order was passed:

"Learned counsel contends that the Civil Judge (Junior Division) Faridabad while adjourning the case for 17.11.2020, ignored the nature of prayer and urgency, as the petitioner/plaintiff is facing demolition of his building and therefore, the impugned order calls for interference. Notice of motion for 29.10.2020.

Civil Revision No. 2258 of 2020 At the asking of the Court, Mr. Sukhdeep Parmar, DAG, Haryana accepts notice on behalf of respondent Nos.1 to 3.

Till the next date of hearing, parties to maintain status quo".

Keeping in view the facts of the case, it is considered appropriate to direct the trial Court to decide the application for grant of injunction within a period of six weeks from today. Till then, the interim protection granted vide order dated 15.09.2020 shall continue to operate. It is clarified that this Court has not expressed any opinion on the merits of the case and the trial Court would independently appraise the material available and pass the order in accordance with law.
