The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to release the notional annual increment for one continuous year of service along with consequential benefits. He is further seeking to decide his representation dated 09.01.2024 (Annexure P-2). 2.

The petitioner is ex-employee of respondent-department. He has retired on attaining the age of superannuation. He is seeking one notional annual grade increment on the ground that he has completed 1 year service in the month of March and increment was granted w.e.f. April.

CWP-15223-2024 the petitioner, at this stage would be redressed, if respondents are directed to decide his representation dated 09.01.2024 (Annexure P-2) in terms of judgment of Supreme Court in 'Director (Admn and HR) KPTCL and others Vs. C.P. Mundinamani and others' 2023 SCC OnLine SC 401. 4.

Mr. Arun Gupta, DAG, Punjab, accepts notice on behalf of the respondent-State and waive service.

With the consent of both sides, the matter is taken up for final disposal.

Learned counsel for the respondents asserts that he has no objection, if petition is disposed of with a direction to respondents to decide representation of the petitioner in a time bound manner and in view of judgment of Supreme Court in C.P. Mundinamani and others (supra).

In the wake of statement of both sides, the present petition stands disposed of with a direction to respondents to decide claim of the petitioner within 3 months from today. The Competent Authority is expected to consider judgment of Supreme Court in C.P. Mundinamani and others (supra) while adjudicating claim of the petitioner.
