For the reasons mentioned in the application, the same is allowed and accompanying Synopsis along with Annexures R-2/1 to R-2/6 are taken on record, subject to all just exceptions. The application stands disposed of.
Main Case :
Present petition has been filed under Section 482 of BNSS for grant of anticipatory bail to the petitioner in FIR No.14 dated 14.02.2025 under Section 420 and 120-B IPC, registered at Police Station Division-C, District Police Commissionerate, Amritsar.
Vide order dated 06.05.2025 passed by this Court, notice of motion was issued in this case and learned State counsel sought time to file MONIKA 2025.07.09 18:04 I attest to the accuracy and integrity of this document
CRM-M-24519-2025 (O&M) Status Report, which has been filed today in Court and the same is taken on record. On that day, the petitioner was granted interim bail while directing him to join investigation, as and when called for. Learned State counsel, while referring to the Status Report, has stated that in compliance of the aforesaid order dated 06.05.2025 passed by this Court, the petitioner, though has joined the investigation but has not co-operated with the Investigating Agency properly and Wills dated 09.09.1985 and 17.05.1993 have not been handed over to the police. It has been brought to the notice of this Court by learned counsel for the petitioner that in para 10 of the Status Report, it has been mentioned that petitioner Surjit Singh had disclosed before the police that the original Wills of 1985 and 1993 were in the possession of his nephew i.e. co-accused Jaswinder Singh.
In view of the fact that the petitioner has already join investigation, his custodial interrogation is not required. The instant petition is allowed and the relief, as extended to the petitioner by this Court vide order dated 06.05.2025, is hereby made absolute. However, the petitioner shall continue to join the investigation as and when required/called upon to do so and shall also strictly abide by all the conditions, as laid down in Section 482(2) BNSS.
