5 6The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No.56 dated 19.4.2022, Police Station Mansa Devi Complex, Panchkula, under Sections 406, 420, 120-B IPC.

The allegations, in nutshell are that the petitioner as well as co-accused Gurdev Singh while holding out false representations of doubling the amount deprived the complainant and his family of an amount of Rs.3.5 lakhs.

Learned counsel for the petitioner submits that the FIR came to be lodged on account of some misunderstanding and the matter has been resolved and a compromise was effected on 30.5.2022 (Annexure P-2), as per which the entire amount of Rs.3.5 lakhs stands returned. also been submitted that co-accused Gurdev Singh has already been granted bail.

Learned counsel has submitted that although the compromise dated 30.5.2022 (Annexure P-2) is recorded between Roopwati complainant and co-accused Gurdev Singh, but in para No.3 it is specifically mentioned that the petitioner has nothing to do with the FIR and that he has no role in the said FIR.

Notice of motion for 06.09.2022.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.7 8 9
