Present petition has been filed under Section 528 of the BNSS for quashing of the impugned order dated 06.12.2025 passed in appeal No. CRA-534-2025 titled as "Angrej Singh Vs. Gurdiyal Singh" by learned Additional Sessions Judge, Fazilka vide which the petitioner was directed to deposit 10% of the compensation amount within 60 days from the date of the passing of the said order.

After arguing the matter at some length and on being confronted with the absence of any material placed before this Court to form any opinion otherwise or on the basis whereof it may be assumed that the direction to make pre-deposit suffers from any judicial mis-appreciation, learned counsel appearing on behalf of the petitioner seeks withdrawal of the present petition with liberty to move an appropriate application alongwith supporting documents for waiver of 10% of the compensation amount i.e. pre-deposit required to be made.

It is directed that in the event such application alongwith SANJAY 2026.05.05 16:54 I attest to the accuracy and integrity of this document
CRM-M-24209-2026 -2supporting documents is moved by the petitioner, the First Appellate Court shall consider the said application in view of the law laid down by the Hon'ble Supreme Court in Criminal Appeal No.2741 of 2023 decided on 04.09.2023 titled "Jamboo Bhandari Vs. M.P. State Industrial Development Corporation Ltd. and others".

In view of the above, the instant petition stands dismissed as withdrawn with liberty as aforesaid.
