Main case 1.

By way of this petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the petitioner seeks quashing of FIR No.237 dated 19.12.2023 under Sections 427, 336 of IPC, 1860 and Sections 25, 27 of Arms Act, 1959 registered at Police Station Civil Lines, Amritsar, District Police Commissionerate Amritsar (Annexure P-1) alongwith all consequential proceedings arising therefrom on the basis of affidavit of the complainant in

CRM-M-24536-2025(O&M) -2lieu of the compromise dated 07.04.2025 (Annexure P-2). 2.

Notice of motion.

Mr. Kamalpreet Bawa, DAG, Punjab, accepts notice on behalf of the respondent-State.

Mr. Robin Gill, Advocate and Ms. Paras Khindri, Advocate accept notice on behalf of respondent No.2 by way of filing Power of Attorney and confirms the factum of the compromise having been effected between the parties and states that respondent No.2 has no objection to the quashing of FIR in question. 5.

Learned State counsel has stated no objection in case the FIR is quashed based upon the compromise. He further states that the petitioner is not involved in any other case.

I have heard learned counsel for the parties and perused the material placed on record.

In view of the above, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences, therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 9.

Accordingly, the petition is allowed and FIR No.237 dated 19.12.2023 under Sections 427, 336 of IPC, 1860 and Sections 25, 27 of Arms Act, 1959 registered at Police Station Civil Lines, Amritsar, District Police Commissionerate Amritsar (Annexure P-1) alongwith all consequential proceedings arising therefrom are quashed qua the petitioners subject to payment of costs of Rs.5,000/- to be paid to the High Court Legal Services Authority.

Needless to say that the parties shall remain bound by the terms of compromise.
