Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.22 dated 31.01.2018 under Sections 104 and 103 of Trade Marks Act, 1999 read with Section 420 IPC, registered at Police Station Civil Lines, Batala, District Gurdaspur. Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. Learned counsel for the petitioners argued that suit for VINEET GULATI 2018.08.21 14:15 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-7735 of 2018 -2rendition of accounts for the profits earned by the petitioners has been filed by the complainant on 15.03.2017 and on the same set of allegations, FIR has been got registered on 31.01.2018.

Learned State counsel contended that after investigation, cancellation report has been prepared and has already been filed before the trial Court.

The petitioners have already joined the investigation. They are not required for investigation or custodial interrogation. No useful purpose will be served by sending them to custody.

Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioners are entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 14.03.2018 granting interim bail to the petitioners, is made absolute.
