(ORAL) This is a petition that has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No. 23 dated 24.03.2015 under Sections 376, 363, 366, 506, 34 IPC and Sections 3 & 4 of POCSO Act, registered at Police Station City Malout, District Sri Muktsar sahib.

Learned counsel for the petitioner would contend that the petitioner has been summoned under Section 319 Cr.P.C. It is argued that name of the petitioner was not reflected either in the statement under Section 161 Cr.P.C., 164 Cr.P.C. or FIR itself as well as in the inquiry. It is contended that pursuant to the order dated 11.01.2018, the petitioner herein has put in appearance before the trial Court and has been admitted to bail by order dated 11.06.2018 and that he is facing trial therein.
