-.- KARAMJIT SINGH , J. (Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.323 dated 17.8.2021 registered under Sections 199, 200, 419, 420, 465, 467, 468, 471, 474 IPC at Police Station Division No.5 District Ludhaina.

As per the allegations recorded in the FIR the petitioner who stood surety for one Rahul Kumar, while furnishing surety bonds, produced fake AADHAR card before the Court concerned.

The counsel for the petitioner inter alia contends that the petitioner has been falsely implicated in the present case and otherwise also GAURAV SOROT 2023.01.20 17:57 I attest to the accuracy and authenticity of this order, judgment and documents.

( 2 ) CRM-M-29328-2022 after completion of investigation the police has presented challan and petitioner is in custody for the last 1 year and 5 months and it will take considerable time for trial to terminate, so prayer is made that petitioner be released on regular bail.

The instant petition is resisted by the State counsel, who on instructions from ASI Raj Kumar has not disputed the fact that now trial has commenced and 2 prosecution witnesses have been examined. I have considered the submissions made by counsel for the parties.

Admittedly all the offences are trialable for the Court of Judicial Magistrate Ist Class and the petitioner is in custody for the last 1 year and 5 months and is having no criminal history as per the custody certificate furnished by the State counsel.

In view of the above, as it will take time for the trial to conclude, so no purpose is going to be served by keeping the accused behind the bars for any longer period.

Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
