IN THE HIGH COURT OF PUNJAB & HARYANA

AT CHANDIGARH CWP-12813-2024 Date of decision: 28.05.2024 Amandeep ....Petitioner

Versus

State of Punjab and others

...Respondents

CORAM: HON'BLE MR. JUSTICE AMAN CHAUDHARY ***** Present :

Mr. Vikas Chatrath, Advocate for the petitioner. ***** AMAN CHAUDHARY. J (Oral) 1.

The prayer made in the present petition is for quashing the action of the respondents whereby the seats earmarked for the General (Sports) Category was de-reserved despite the fact that the petitioner was available and for declaration to the effect that the select list of ETT Teacher is factually and legally untenable.

2.

Learned counsel would submit that the petitioner was an aspirant for appointment to the post of ETT Teacher pursuant to the advertisement dated 30.07.2021, Annexure P-1, under the General (Sports) Category, which has been de-reserved, despite her availability and only 47 posts out of 133 have been filled. In this regard, representations dated 10.10.2023 and 25.01.2024, Annexures P-18 and P-19, have been submitted, which have yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioner is sanguine of it being considered in a positive manner, in case, a direction is given to respondent No.2 to decide the same in a time bound manner by granting her an opportunity of hearing. HAMANT 2024.05.30 09:20 I attest to the accuracy and integrity of this order/judgment

CWP-12813-2024 3.

Notice of motion.

4.

At the asking of the Court, Mr. Swapan Shorey, DAG, Punjab accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

5.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.2 to decide the representation dated 25.01.2024, Annexure P-19, within a period of six months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner.
