Prayer made in the present petition is for directing the respondents to prospectively fix the family pension of the petitioner as per rules after deducting DA, which is not admissible to him in view of the appointment of their wards on govt. post and not to recover the excess amount which was already paid. 2.
This Court while issuing notice of motion on 22.09.2011, ordered stay of deduction, if any, from the family pension of the petitioner. In the index of the petition, reference was made on CWP-891-2003 titled as Mukhtiar Singh and others vs. State of Punjab and others, which was disposed of on 20.01.2004, against which no SLP was filed, wherein the writ petition was dismissed insofar as the claim for dearness allowance on family pension was concerned, however in respect of recovery sought the prayer was allowed, based on which CWP-10052009 was also disposed of on 22.01.2009, which fact learned State counsel despite best efforts has been unable to controvert and resist disposal of the petition in terms thereof or cite any contrary law.
