Present application has been filed under Section 528 of BNSS, 2023, for seeking pre-ponement of the date of hearing in the main case, i.e., CRM-M24668-2025, from 11.09.2025 to an early date. ii.

Counsel for the applicant-petitioner submits that while issuing notice of motion, proceedings in the main case were fixed for 09.05.2025, however, due to heavy workload, matter could not be taken up for hearing on the date fixed, and same was adjourned for a very long date, i.e., 11.09.2025.

In the absence of any interim protection, the present application has been filed seeking preponement of the date of hearing in the main case. iii.

Notice of this application.

Mr. Neeraj Madaan, Sr. DAG, Punjab, who is present in Court, accepts notice on behalf of non-applicant/respondent and pleads no objection to the prayer made in the application.

In view of the averments made in the application, prayer made therein is allowed. Consequently, date of hearing in the main case is advanced from 11.09.2025 to today itself i.e. 19.05.2025.

Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name & age of Petitioner (s) FIR No.

Learned counsel for the petitioner submits that the name of the petitioner - Ajay, aged 33 years, has been implicated in the present case merely on account of him being the neighbour of the main accused, namely, Rajat @ Billa.

Further submits that the version put forth by the complainant in the FIR appears to be motivated, as there seems no plausible reason to specifically name all the alleged snatchers. In fact, the petitioner and the complainant both belong to the same town, and even the other co-accused are also residents of Rajpura town and have been knowing each other.

Learned State counsel does not dispute the factual submissions made by the petitioner's counsel and affirms that there is no other criminal case registered against the petitioner of similar nature.

In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).

Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport.

It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court.

Let a comprehensive status report, detailing the antecedents of all the accused persons, including their respective places of residence, be filed on or before the next date of hearing."
