Petitioner has preferred this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case bearing FIR No.0169 dated 03.10.2019 under Section 22 of NDPS Act (Section 29 of NDPS Act added vide DDR No.33 dated 15.11.2019) registered at Police Station Jhunir, District Mansa. As per note appearing on the first page of order dated 16.02.2021 passed by Judge, Special Court, Mansa, it has been shown that challan has already been presented before the Additional Sessions Judge, Mansa and the trial was fixed at one point of time on 22.03.2021.

CRM-M No. 32749 of 2021 -2Learned State counsel on instructions from ASI Jagjit Singh submits that the petitioner is not an accused in the challan and filing of present petition is ill advised.
