(ORAL) The petitioner has filed this writ petition being aggrieved by an order dated 31.05.2022 (Annexure P-14) and an award as mentioned in the Tender Summary Reports (Annexures P-4 and P-5), wherein its tender application has been rejected on flimsy grounds that it did not deposit the latest bid capacity certificate as per government notification dated 02.08.2018 (Annexure P-7) and did not submit hardcopies of the documents. Admittedly, the tender notice was issued on 30.09.2021 and the contract in question was awarded to respondent No. 3 from 31.10.

2021 and the work period of the contract was two months and, therefore all the necessary steps in respect of the impugned tender have already been completed and in such circumstances, learned counsel for the petitioner does not dispute the fact that the writ petition has been rendered infructuous with the efflux of time. He, however, submits that the legal issue and the question raised by the petitioner in the writ petition be kept open for adjudication in an appropriate case. In the circumstances, the writ petition is dismissed as infructuous leaving the question raised by the petitioner open for adjudication in an appropriate proceeding.
