The petitioner was a student of D.EI.Ed Course for the Session 2021-2023 and has passed the first examination in 2023. However, she remained absent in the second year examination held on 20.08.2024 and was declared absent. The petitioner has now approached this Court seeking quashing of speaking order dated 22.04.2026 (Annexure P-6) on the ground that some of the students have now been allowed to appear in examination as the date-sheet has been issued for the Session 2021-2023, second year last chance.

As per the NCTE Regulations, which govern the D.EI.Ed programs, a candidate is required to complete the course within a maximum period of three years. The petitioner's classes for first year Session started from 10.03.2022 and accordingly, she is required to complete her course by March 2025. The petitioner cleared her first year examination in the year 2023 and remained absent in second year examination. Therefore, it is clearly transpired that the petitioner is not in a position to clear the examination within a prescribed limit of three years. The petitioner is unable to point out any Rules and Regulations through which she can be granted any relaxation to appear in examination after completion of three years.

In view of the discussion made hereinabove, the present petition is dismissed.
