Dated Police Station Sections 13.07.2023 Khanna City-II, District 379-B IPC (411 IPC added later Khanna on) Seeking modification of the order dated 20.03.2024 passed by the Sessions Judge, Ludhiana in the FIR captioned above, petitioner has come up before this Court by filing the present petition under Section 482 CrPC.

Petitioner's counsel submits that the petitioner had cleared IELTS and on that basis, he got admission in college at Canada, therefore he approached the trial Court for seeking permission to go abroad for two years, but the learned Sessions Judge, Ludhiana, vide order dated 20.03.2024, had granted permission of only six months instead of two years. He further submits that educational course of the petitioner is of two years, therefore he seeks modification of the order dated 20.03.2024 to the extent of extending the time from six months to two years.

Notices are served upon the official respondents through the State's counsel. Given the nature of the order that this Court proposes to pass, neither the response of official respondents nor the issuance of notices to the private respondents is required. State counsel objects to the petition that on the ground that such permission will cause delay in trial.

Given the facts peculiar to this case, order dated 20.03.2024 is modified and the petitioner is permitted to return from Canada on or before 30.09.2026, in the same terms as in the order dated 20.03.2024.
