(ORAL) CM-22865-CII-2024 This is an application filed under Section 151 CPC for disposing of the present appeal in terms of the judgment dated 19.11.2024 (Annexure R-3/1) passed by this Court in the connected appeal i.e. FAO3088-2006 and seeking exemption from filing certified and typed copy of Annexure R-3/1.

For the reasons mentioned in the application, the same is allowed as prayed for and the main case is taken on Board today itself. FAO-3984-2006 (O&M) 1.

The learned counsel for the respondent-Insurance Company contends that the appeal bearing No. FAO-3088-2006 has already been decided by this Court, vide judgment dated 19.11.2024, wherein, the share from the enhanced amount of compensation has already been granted to the VIRENDRA SINGH ADHIKARI 2025.01.14 12:20 I attest to the accuracy and integrity of this document

FAO-3984-2006 (O&M) -2present appellant/claimant, therefore, this appeal be disposed of in view thereof.

I have heard the learned counsel for the respondent-Insurance Company and have gone through the judgment dated 19.11.2024 passed in FAO-3088-2006 by this Court, wherein, the share out of enhanced amount of compensation has already been awarded to the present appellant/claimant as per ratio settled in the award dated 18.01.2006, therefore, no further cause of action survives in this appeal.

In view of the above, this appeal is disposed of in the same terms.

Respondent No.3-Insurance Company is hereby directed to disburse the current scheduled fee to Mr. Harsh Aggarwal, Advocate, within a period of 20 days from the date of receipt of the copy of this judgment, in view of the order dated 18.07.2024 passed in FAO No.1682 of 2007 by this Court.
