This is fourth petition, filed by the petitioner, for grant of regular bail to him pending trial in a criminal case arising from FIR No. 42 dated 25.06.2019, registered under Section 20/61/85 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as "the 1985 Act"), at Police Station Mansa Devi Complex, Panchkula. As per the case of the prosecution, the accused was allegedly found in conscious possession of 300 grams of charas and there were four more cases under the 1985 Act against the petitioner, out of which, he has been acquitted in one case. However, including the present case, there are still four cases pending against the petitioner under the 1985 Act.. Criminal Misc. No. M- 28189 of 2020 of the trial is likely to take time and the petitioner is in custody for quite some time.
This Court has considered the submissions of learned counsel for the parties.
Keeping in view the provisions of Section 37 of the 1985 Act and the involvement of the petitioner in various other cases, this Court does not find any ground to grant the concession of regular bail to him. Hence, the present petition is dismissed.
