The present revision petition has been filed challenging the order dated 04.11.2024 (Annexure P-3) whereby the evidence of the defendant-petitioners has been closed by order. 2.

Learned counsel for the defendant-petitioners would contend that given two effective opportunities, the defendant-petitioners would conclude their evidence at their own risk and responsibility and that they are also wiling to compensate the plaintiff-respondent Nos.1 and 2 by way of costs.

Per contra the learned counsel for respondent Nos.1 and 2 would contend that despite numerous opportunities, the evidence was not led and, hence, the order dated 04.11.2024 cannot be faulted with. 4.

I have heard the learned counsel for the parties. 5.

In the present case the suit has been filed by the plaintiffrespondent Nos.1 and 2 for declaration with consequential relief of Yogesh Sharma 2025.05.14 11:30 I attest to the accuracy and authenticity of this order/judgment.

CR-2778-2025 (O&M) -2permanent injunction. No doubt the defendant-petitioners have been remiss in leading their evidence, however, keeping in view the nature of the suit and in order to do complete justice between the parties, this Court deems it appropriate to grant two effective opportunities to the defendant-petitioners to conclude their entire evidence at their own risk and responsibility, subject to payment of costs of ₹30,000/- to be paid to the plaintiff-respondent Nos.1 and 2, which shall be a condition precedent.

It is made clear that in case the costs are not paid, the present revision petition shall be deemed to having been dismissed. 7.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
