**** JITENDRA CHAUHAN J. (ORAL) Learned State counsel states that despite repeated communications, response from the petitioner has not been received and the necessary instructions could not be obtained.

At this stage, learned State counsel, on instructions, states that the petitioner had joined as Constable in the State of Haryana and probably on that account the petitioner has not come forward.

However, without adverting to the assertions raised by learned State counsel, the case is ordered to be dismissed for non-prosecution, as the petitioner has failed to assist learned counsel on the issue in the present case.
