*** ANIL KSHETARPAL, J (Oral) Through this application, the petitioner (wife) prays for transfer of petition, bearing No.DMC/665/2020 filed under Section 9 of the Hindu Marriage Act, 1955, titled as 'Pardeep vs. Alka' pending before the Court of Principal District Judge, Family Court, Hisar, to the Court of competent jurisdiction at Rohtak.

The petitioner has filed a petition under Section 13 of the Hindu Marriage Act, 1955, against the respondent at Rohtak which is stated to be pending. It has further been claimed that the petitioner is residing with her parents at Rohtak and distance between Hisar and Rohtak is approximately 100 kms. She is stated to have no independent source of income. As per the office report, dasti notice issued to the respondent has been served through trial Court counsel. However, he has chosen not to enter appearance.

TA-702-2021 (O&M) file of DMC/665/2020 (Pardeep vs. Alka) pending in the Court of Principal District Judge, Family Court, Hisar, is ordered to be transferred to the Court of competent jurisdiction at Rohtak. The transferor Court is requested to remit the case file to the transferee Court forthwith. The petitioner is directed to appear before the District Judge, Rohtak, on 28.09.2021 who shall either decide the matter himself or assign it to the Court of competent jurisdiction at Rohtak.

All the pending miscellaneous application(s), if any, are also disposed of.
