*** ANIL KSHETARPAL, J (Oral) Through this application, the petitioner (wife) prays for transfer of petition, bearing No.DMC/668/2020 filed under Section 9 of the Hindu Marriage Act, 1955, titled as 'Kuldeep vs. Asha' pending before the Court of Principal District Judge, Family Court, Hisar, to the Court of competent jurisdiction at Rohtak.

It is claimed that the petitioner is residing with her minor son, aged about 41⁄2 years, in her parental place at Rohtak. She further asserted that the respondent is already defending the proceedings under Section 125 Cr.P.C.

As per the office report, dasti notice issued to the respondent has been served through his trial Court counsel. However, he has chosen not to enter appearance.

Keeping in view the aforesaid facts, the petition is allowed. The file of DMC/668/2020 (Kuldeep vs. Asha) pending in the Court of Principal ASHOK KUMAR 2021.09.09 14:51 I attest to the accuracy and integrity of this document

TA-706-2021 (O&M) District Judge, Family Court, Hisar, is ordered to be transferred to the Court of competent jurisdiction at Rohtak. The transferor Court is requested to remit the case file to the transferee Court forthwith. The petitioner is directed to appear before the District Judge, Rohtak, on 28.09.2021 who shall either decide the matter himself or assign it to the Court of competent jurisdiction at Rohtak.

All the pending miscellaneous application(s), if any, are also disposed of.
