Petitioners Jinder Kaur and Pawan Kumar @ Pammu have filed petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail in FIR No.0003 dated 06.01.2025, under Sections 80, 3(5) of BNS 2023, registered at Police Station Sri Anandpur Sahib, Punjab (Annexure P-1). 2.
As per facts of the case, complainant Kuldeep Chand gave his statement that marriage of his daughter Gurpreet Kaur aged about 26 years was performed with Sohan Singh in the year 2022. He had given dowry as per his capacity. His son-in-law Sohan Singh was serving in Indian Army. His daughter was residing with her in-laws family consisting of father-inlaw Gurdial Singh, mother-in-law Harbansi, jeth/elder brother-in-law Pawan
Kumar @ Pammu, Jethani Jinder Kaur. The aforesaid persons started harassing his daughter in connivance with each other. Matter was compromised verbally on 4-5 occasions. He disclosed everything to his sonin-law Sohan Singh who stated that he had tried to make his family understand. On 05.01.2025 at about 5:15 PM, he received telephonic call from the brother of her father-in-law that his daughter has expired. On reaching the matrimonial home, they found dead body of his daughter kept in the verandah covered with a cloth. The aforesaid persons provoked his daughter to commit suicide by taunting her that her father could not give a motorcycle or a car. Being fed up with the maltreatment given to her, his daughter has finished her life.

Learned counsel for petitioners argued that all allegations levelled against the petitioners are false. They were residing separately. They had nothing to do with the matrimonial life of the deceased victim. Both petitioners were arrested on 07.01.2025 and till date they are behind the bars. It is pointed out that husband of deceased victim has not been named as accused.
Mr. Bikramjit Singh Randhawa, Advocate appeared on behalf of complainant and filed vakalatnama, which is taken on record. 4.
Status report is filed confirming the allegations. Learned counsel representing State assisted by learned counsel for complainant pointed out that there are specific allegations against both the petitioners for physical and mental cruelty caused to the deceased victim for bringing less dowry and on the pretext for not bringing motorcycle or a car in dowry. . completion of investigation challan has been presented. The trial is at initial stage as charges are yet to be framed. 5.
I have considered the aforesaid factual position. Considering the contents of FIR there are specific serious allegations against both the petitioners regarding maltreatment on account of demand for more dowry. The victim died unnatural death in the matrimonial home within about two years of marriage. Post-mortem was conducted by the Board of Doctors of Civil Hospital, Sri Anandpur Sahib and on receipt of report of Chemical Examiner, Punjab the cause of death was given as "asphyxia due to hanging antemortem in nature and is sufficient to cause death in ordinary course of nature". The trial is at initial stage.
Considering the specific allegations and gravity of offence, I do not find a fit case for grant of regular bail and the same is accordingly declined. 6.
