The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing FIR No.268 dated 07.11.2025 (Annexure P-1) registered under Sections 103(1), 3(5) of BNS 2023 at Police Station Shahkot, District Jalandhar (Rural).

The present FIR came to be registered at the instance of Gurmukh @ Jeewan and reads as under:- "Statement of Gurmukh @ Jeewan son of Ram Murti resident of Village Mehmuwal Yusfpur, Police Station Shahkot, District Jalandhar aged about 33 years, mobile No. 9780122013. Stated that I am resident of above address and run flour mill in my residential house at Village Mehmuwal Yusfpur. On 26.10.2025 a son was born to Dalwinder Kumar who is son of my real paternal uncle in our relations. He had arranged a party at his house for celebrating the birth of the son. I

CRM-M-24230-2026 -2alongwith my elder brother Sandeep Kumar @ Seepa aged about 39 years, Satwinder Singh @ Sunny, Mithun Kumar @ Money sons of Gurudial Chand who is also my younger paternal uncle, Daljit Singh @ Meepa son of Jaspal Singh, Mintu son of Bhag Chand residents of Mehmuwal Yusfpur, Police Station Shahkot attended the said party. All of us were drinking liquor while sitting on chairs at one place on the roof of the house at about 08:00/08:30 PM. At that time, Mithun Kumar @ Money who had consumed lot of liquor and while we were sitting there, he started fighting with his elder brother Satwant Singh @ Sunny. Both of them started grappling with each other. Therefore, my elder brother Sandeep Kumar @ Seepa while stopping both of them from fighting started to make them understand.

On this, Satwant Singh @ Sunny and Mithun Kumar @ Money above said after stopping intersee fight between them, started fighting with my brother Sandeep Kumar @ Seepa. Mithun Kumar @ Money after running climbed over the roof of the Kotha. Satwant Singh @ Sunny while giving fist blows to my brother Sandeep Kumar @ Seepa threw him on the roof top. Mithun Kumar @ Money started pelting bricks from the roof on my brother Sandeep Kumar @ Seepa while I was seeing with my naked eyes. One of the bricks hit in between the head of my brother Sandeep Kumar @ Seepa due to which my brother was soaked with blood. Thereafter, Satwant Singh @ Sunny and Mithun Kumar @ Money above said fled away from the spot by taking advantage of darkness.

Thereafter, I alongwith Dalwinder Kumar son my younger paternal uncle after arranging for a vehicle took Sandeep Kumar @ Seepa to Sidana Hospital Shahkot for treatment. The doctor after giving first aid sent us back to our house. On 27.10.

CRM-M-24230-2026 -3brother Sandeep Kumar @ Seepa expired today on 07.11.2025 at about 09:00/09:30 AM during his treatment. My brother Sandeep Kumar @ Seepa has been murdered by Satwant Singh @ Sunny and Mithun Kumar @ Money sons of Gurdial Singh resident of Mehmuwal Yusfpur, Police Station Shahkot by giving injuries to him. Strict action may be taken against him. I have got recorded my statement. I have heard the same. I have also read it. It is correct. Sd/- Gurmukh Singh." 3.

The learned counsel for the petitioner contends that the occurrence has taken place on the spur of the moment, when Mithun Kumar @ Money was fighting with his elder brother Satwant Singh @ Sunny (petitioner). It was on the intervention of Sandeep Kumar @ Seepa (since deceased) that the two brothers stopped fighting with each other and, in fact, attacked him. When the deceased was taken in an injured condition to Civil Hospital, Shahkot, on 26.10.2025, i.e. the night of the occurrence, the history given was of a road-side accident. On 27.10.2025, the then injured was taken to another hospital, where the history given was of falling from the stairs along with the remark that the injured was a chronic alcoholic. The death took place on 07.11.2025.

A perusal of the post-mortem report would reveal injuries on the eyebrow, temporo parietal region and a surgical mark on the neck. The injuries have been attributed to the co-accused of the petitioner namely Mitun Kumar @ Money. As the petitioner is in custody since 21.11.2025 but none of the 29 prosecution witnesses has been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

CRM-M-24230-2026 -43. On the other hand, the learned State counsel contends that the petitioner and his brother Mithun Kumar @ Money, assaulted the deceased, leading to his death. The nature of the allegations levelled against the petitioner do not entitle him to the concession of bail. He, however concedes that the petitioner is a first-time offender, is in custody since 21.11.2025 and that none of the 29 prosecution witnesses has been examined so far. 4.

I have heard the learned counsel for the parties. 5.

The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 21.11.2025 but none of the 29 prosecution witnesses has been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation the further incarceration of the petitioner is not required. 6.

Thus without commenting on the merits of the case, the present petition is allowed and petitioner-Satwant Singh @ Sunny S/o Gurdial Chand is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7.

The petition stands disposed of.
