CORAM:

HON'BLE MR. JUSTICE INDERJIT SINGH

Present:

Mr.Jai Singh Yadav, Advocate for the petitioner.

**** INDERJIT SINGH, J.

The petitioner has filed this criminal writ petition against State of Haryana and other respondents under Article 226/227 of the Constitution of India in the nature of Habeas Corpus for giving custody of Manisha, who is under unlawful detention of Protection House at Police Line Nuh, Mewat. I have heard learned counsel for the petitioner and have gone through the record.

At the time of arguments, learned counsel for the petitioner contended that detenue Manisha has been kept in Protection House at Nuh. It is admitted by learned counsel for the petitioner that Manisha along with another person filed protection petition and in that petition, this Court vivde order dated 01.05.2019, directed Superintendent of Police, Nuh to consider the representation dated 26.04.2019 and take appropriate steps to ensure VINEET GULATI 2019.05.31 16:58 I attest to the accuracy and authenticity of this document Chandigarh that no harm is caused to their life and liberty. In compliance of the above-

CRWP No.496 of 2019 -2said order of this Court, detenue has been kept in the safe house/Protection House, Nuh.

Learned counsel for the petitioner, on enquiry, also admitted that protection was sought against the petitioner also. From the perusal of the record, I find that protection has already been sought by the detenue and protection has been given to her by keeping her in the Protection House, Nuh. Even if, it is taken that age of the detenue is 17 years 9 months as argued, even then, it cannot be held that she has been illegally detained in the Protection House, Nuh. Therefore, finding on merit in the present petition, the same is dismissed.
