The petitioner while on parole for 30 days from 12.1.2015 to 12.2.2015, through the instant petition seeks extension of parole on the ground that his wife is to be operated upon for utrine bleeding. In support of his claim, a certificate of Private charitable hospital has been placed on record.

I have considered the facts and circumstances of the case. The petitioner could have applied for emergency parole in accordance with the rules by moving an application before the competent State authorities. The medical certificate now produced is dated 8.2.2015. The High Court u/s 482 Cr.P.C. does not seem to have jurisdiction to grant relief in the above said circumstances.

The petition is disposed of as not maintainable without prejudice to the right of the petitioner to avail any remedy by approaching the competent authorities under law for the purpose of parole.
