Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present petition on the basis of disclosure statement suffered by friend of the deceased. He further submits that provisions of Section 302 IPC are not made out against the petitioner and due to some old enmity, the petitioner has been roped in the present case and only motor-cycle has been recovered from him. Learned State counsel has filed the custody certificate of the petitioner, which is taken on record. He prays for dismissal of the present petition stating that the allegations against the petitioner are serious in nature.
