The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 03.09.2008 whereby he was terminated despite 13 years' service. 2.
Notice of motion was issued on 27.03.2009 and operation of order of termination was stayed.

Learned State counsel submits that petitioner passed away in November' 2011. The petitioner in view of interim order of this Court continued to work till November' 2011. He completed 15 years' service. 4.
Learned counsel for the petitioner submits that petitioner's son was not considered for any financial benefits on account of pendency of instant petition. He may be granted liberty to approach authorities to seek financial assistance in accordance with policy. 5.
