Instant writ petition has been filed under Articles 226/227 of the Constitution of India for quashing the order dated 28.02.2013 (Annexure P-10), passed by respondents vide which the objections raised by the petitioner vis-a-vis seniority of private respondent and altering the seniority without any basis have been rejected and for directing the respondents to consider the claim of the petitioner for promotion as Superintending Engineer over and above private respondent and for staying the further promotion of the private respondent or in the alternative for staying the operation of impugned order dated 28.02.2013 (Annexure P-10) along with the implementation of altered seniority (Annexure P-11).

On 18.09.2024, the following order was passed: - "Learned State counsel submits that the dispute raised in the present petition is with regard to the seniority RAVINDER SINGH 2026.07.01 16:19 I attest to the accuracy and authenticity of this order/judgment

CWP-12460 of 2013 of the petitioner viz-a-viz Respondent No.3 and during the pendency of the instant petition, both have retired on 26.10.2018 and 30.06.2017, respectively, and perhaps with the efflux of time, the instant petition might have rendered infructuous.

Upon this, learned counsel appearing for the petitioner seeks an adjournment to get instructions from the petitioner.

On her request adjourned to 23.09.2024.

Learned counsel for the petitioner pleads no instructions. Consequently, the present petition is dismissed for want of prosecution. However, liberty is granted to the petitioner to get the present petition revived in case any cause still survives.
