IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CRM M-8073 of 2018 Date of decision : 01.03.2018 Salwant Singh @ Gola ....Petitioner V/s State of Punjab ....Respondent BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Ashish Aggarwal, Advocate for the petitioner. Mr. C.L. Pawar, Sr. DAG Punjab.

Mr. H.S. Baath, Advocate for the complainant. RAJAN GUPTA J.

Petitioner seeks concession of pre-arrest bail in a case registered against him under sections 420, 467, 468,471 IPC vide FIR No. 06 dated 25.01.2018 at police station Jhabhal, district Tarn Taran. It has been urged before the court that petitioner has been falsely implicated in the case by leveling false allegations against him. There is nothing on record to show that he was involved in the commission of crime in any manner. Thus, he deserves the concession of pre-arrest bail. Learned State counsel has opposed the prayer for bail on the ground that petitioner by forging the saledeed has transferred the land in his favour. Thus, he does not deserve the concession of bail.

FIR was lodged at the instance of complainant Talwinder Singh. He alleged that petitioner in connivance with other accused prepared a forged sale-deed dated 25.09.1995 in respect of land measuring 26 kanals 081⁄2 marla situated in village Dode district Tarn Taran which was owned by Ajay Kumar 2018.03.12 10:42 I attest to the accuracy and authenticity of this document

CRM M-8073 of 2018 Tej Kaur. On the basis of same, petitioner transferred the land in question in his favour. Pursuant to the complaint, FIR was registered and investigation ensued. Allegation against the petitioner is that he hatched a conspiracy in connivance with other accused and prepared a forged sale-deed of the land. Thereafter, petitioner transferred the same in his favour thereby depriving the real owner of her right in the valuable property. Stand of the investigating agency before this court is that petitioner is a habitual offender. He is involved in number of cases of similar nature. In my considered view custodial interrogation may, thus, be required for taking the investigation to its logical end. Petition is, thus, without any merit and is hereby dismissed.
