This matter is being taken up for hearing through video conferencing due to the outbreak of pandemic, COVID-19. This writ petition has been filed by the petitioner seeking setting aside of impugned order dated 27.08.2020 (Annexure P-16), whereby his services have been terminated on the basis of an inquiry report dated 19.06.2020 (Annexure P-1).
Learned counsel for petitioner submits that in view of objection taken in written statement on behalf of respondents no.2 and 3, that impugned order dated 27.08.2020 is appealable as per Rule 7 of the HDFC Bank Conduct Regulations, petitioner be permitted to withdraw this writ petition with liberty OMKAR SINGH 2021.02.01 14:41 I attest to the accuracy and authenticity of this document
CWP-14859-2020 -2- to file an appeal before the Appellate Authority. However, it is prayed that bar of limitation be not raised against petitioner as this writ petition was filed within 30 days of passing of impugned order 27.08.2020 (Annexure P-16). Keeping in view the facts and circumstances as above, this writ petition is dismissed as withdrawn with liberty to petitioner to file an appeal in terms of Regulation 7 of the HDFC Bank Conduct Regulations. In case, appeal is filed within two weeks from today, question of limitation would be decided by competent authority sympathetically, keeping in view the fact that present writ petition was filed within a period of 30 days of passing of impugned order. Needless to say that appeal so filed shall be decided within a period of 90 days as provided in Regulation 7 of the HDFC Bank Conduct Regulations. !*#$* # $ +()((,
