The petitioner prays for his release on parole as the marriage of his sister is to take place on 11.3.2015.
Reply has been filed by the respondents wherein the factum of marriage of sister of the petitioner is not disputed, but it has been stated in para-2 that on an earlier occasion, the petitioner was released on furlough for a period of three weeks, but he surrendered 172 days after the scheduled date. Criminal W.P. No.332 of 2015 -2If that be so, then the petitioner would not be justifiably entitled to the benefit of parole having violated the terms of furlough already granted to him at one point of time. However, on purely humanitarian considerations, noticing the fact that sister of the petitioner is to be married on 11.3.2015, he will be permitted while in custody, to attend the marriage ceremonies on 11.3.2015. The jail authorities will make the necessary arrangements in this regard. Petition stands disposed of.
