Mr. Munfaid Khan, Advocate for the complainant. *** This is an application for pre arrest bail filed by petitioners Daud, Sahid, Tayyub, Israil, Aakil and Mubin accused in F.I.R. No. 87 dated 11.02.2018 under Section 148, 149, 323, 324, 285, 506 IPC read with Section 25/54/59 of the Arms Act later on added Section 326 IPC registered with Police Station Nuh, District Nuh.
Briefly stated the facts of the case as per prosecution story are that on 10.2.2018 at about 5/5.30 P.M., an incident took place in which several persons including the petitioners assaulted complainant Javed and Anjum who had suffered injuries. The injury on the person of complainant which was declared to be grievous is attributed to non petitioner Sohrab, whereas to the petitioners the injuries which are attributed are simple in nature. The petitioners have since joined the investigation in terms of the Parvinder Singh 2018.04.18 17:28 I attest to the accuracy and integrity of this document Chandigarh

Learned State counsel on instructions from HC Nasim Akhtar stated that lathis have since been recovered from petitioners Tayyub and Israil and petitioners are not required by the police for further investigation. Therefore, considering the facts and circumstances of the case and statement made by the State counsel, the interim bail granted to the petitioners on 23.2.2018 is made absolute, subject to their fulfilling conditions under Section 438(2) Cr.P.C.
The petition stands allowed accordingly.
