Present application has been filed u/s 528 of BNSS, 2023, for preponing the date of hearing in the main case, i.e., CRM-M-25795-2025, from 21.08.2025 to an early date.

Counsel for the applicant-petitioner submits that since the main co-accused, i.e., Dilshad, and even other co-accused, namely: Roshan, Aasif, Mubarik, and Jafar, have also been granted concession of bail by the trial Court, after dismissal of the bail application of the present applicantappellant by the trial Court/Court below; hearing in the main case, may kindly be advanced from 21.08.2025 to any earlier date, subject to the convenience of this Court, to enable the petitioner to move a fresh application before the Court of Sessions again. Further, submits that direction be also issued to decide the same by keeping in view of the orders passed by the trial Court/lower Court in the bail orders passed by it qua the JAWALA RAM 2025.07.21 19:54 I attest to the accuracy and authenticity of this document

At this stage, learned State counsel, who is present in Court, accepts notice on behalf of the non-applicant/respondent - State and raises no serious objection to the prayer made in the application. V.

Considering the submissions, and prayer made in the application, same is allowed and the date of hearing in the main case is pre-poned from 21.08.2025 to 18.07.2025, i.e., for today itself, and the main petition is taken up for its hearing.

In view of the orders of even date passed in CRM-29995-2025, main case is taken up for hearing today itself. 2.

Keeping in view the submissions made here-above (in CRM29995-2025), and on request of counsel for the applicant-petitioner, present petition stands dismissed as withdrawn. However, liberty is granted to the petitioner to move an appropriate application afresh before the trial Court/Court below, and thereafter, trial Court/Court below is expected to decide the same on merits again, in accordance with law and also by keeping in view of the orders passed by it, qua the other co-accused namely; Dilshad, Roshan, Aasif, Mubarik and Jafar.
