(Oral) The petitioner has approached this Court seeking issuance of direction to the respondents to give prior notice under Section 160 Cr. P.C. in case he is required in the matter pertaining to FIR No.292, dated 17.8.2020, Police Station City Mandi Dabwali, District Sirsa, under Sections 387, 506 IPC.

Vide order dated 14.9.2020 the following order was passed: "Learned counsel for the petitioner contends that he had earlier been representing one Ravi who was facing a criminal trial and who ultimately came to be declared as a 'Proclaimed Offender' while his co-accused were acquitted. It is submitted that the aforesaid Ravi subsequently came to be involved in another FIR MOHAN SINGH 2021.03.24 17:12 I attest to the accuracy and integrity of this document

- 2 - CRM-M-27685-2020 (O&M) recently lodged i.e. FIR No.292, dated 17.8.2020, Police Station City Mandi Dabwali, District Sirsa, under Sections 387 and 506 IPC and that the said Ravi somehow nurses some grudge against the petitioner who is a practicing lawyer and has perhaps made some statement against him on account of which the police has been raiding the house of the petitioner. Notice of motion for 28.9.2020.

In the meantime, in case the petitioner is required to be summoned by the police with the aid of Section 160 Cr.P.C. in the capacity of any witness for the purpose of eliciting any information then a prior written notice be served upon him."

Having heard learned counsel for the petitioner and in view of the legal position as regards provisions of Section 160 Cr. P.C. which is not disputed by learned State counsel, the petition is disposed off while making the interim directions issued on 14.9.2020 absolute.
