**** ANITA CHAUDHRY, J The petitioner has assailed the order dated 1.10.2016 passed by the Family Court vide which maintenance of Rs. 4,000/- per month has been allowed to the wife and Rs. 1,000/- per month to the child from the date of filing of the petition.

Counsel for the petitioner contends that the petitioner was a student and he was not earning and the respondent had not placed any document to show that the petitioner was a taxi driver or he was earning and the Court below had wrongly allowed maintenance to the respondents. The counsel representing the respondents urges that the petitioner had been challaned by the police under the Motor Vehicles Act and he was driving the vehicle and he has concealed facts and no document had been placed on record to show that he was studying and even the name of the college had not been provided.

Crl. Revision (F) No. 413 of 2016 (O&M) -2The petitioner had failed to disclose the name of the college where he was studying. Even the year of admission has not been disclosed. The Family Court observed that the petitioner had concealed his occupation and income. It also noted that he was skilled and assuming the income, interim maintenance was allowed to the wife and the child. The parties are yet to lead their evidence. It is for the petitioner to come clean before the Court below. I find no infirmity in the findings of the Court below.

The petition is dismissed.
