This criminal writ petition has been registered on the application dated 2.3.2015 sent by Parkash Rani to this Court, which was taken on judicial side.

The report was called from the Police. As per the report, Gurdev Chand-husband of the petitioner has been arrested by the Police of Police Station Sadar, Jalalabad (W), District Fazilka on 8.3.2015. The FIR has been registered for the offences under NDPS Act as well as Section 25 of the Arms Act on 5.3.2015.

Learned counsel for the petitioner stated that as per the application, the husband of the petitioner was picked-up by the Police in illegal manner on 27.2.2015.

Cr.W.P. No.356 of 2015 [2] In the present case, earlier notice was given to Senior Superintendent of Police, Ferozepur, but later on the notice was given to Senior Superintendent of Police, Fazilka. So, in no way, it can be held that after receiving the notice, the accused has been falsely implicated in this case. The Senior Superintendent of Police, Fazilka, was not knowing about these proceedings when the accused was arrested in the FIR. Otherwise also, the application has been taken as Habeas Corpus for illegal detention, but in view of the reply that the husband of the petitioner, namely, Gurdev Chand has been arrested in the criminal case, therefore, in this petition no further action is required. However, the petitioner is at liberty to avail the appropriate remedies, if she feels that Gurdev Chand is innocent etc. With these observations, this petition is disposed of. September 30, 2015.
