CORAM:

HON'BLE MS. JUSTICE RITU BAHRI Present:- Mr. Dinesh Arora, Advocate for the petitioner.

RITU BAHRI J.(Oral) CRM-37589 of 2016 For the reasons mentioned in the application, delay of 33 days in filing the present revision petition is condoned. The application stands disposed of accordingly. Crl. Revn. No. F-420 of 2016 Challenge in the present petition is to the order dated 29.07.2016 passed by learned District Judge Family Court, Gurgaon vide which the respondent father has been directed to pay an amount of Rs.9500/- per month to the petitioner as monthly maintenance. A bare perusal of impugned order shows that the net salary of the respondent for the month of December, 2015 was Rs.24132/- and the learned court below by taking into consideration the salary of the respondent, has rightly granted the monthly maintenance to the petitioner @ 9500/-.

Crl. Revn. No. F-420 of 2016 (O&M) Learned counsel contends that the maintenance granted to the petitioner is on the lower side, as the petitioner has now been shifted to less reputed school by her mother, keeping in view the fact that she has been awarded less maintenance, vide impugned order. This argument is liable to be rejected as after deducting Rs.9500/- from Rs.24132/-, the respondent will have Rs.15000/- per month, which is not on the higher side.

The the order dated 29.07.2016 passed by learned District Judge Family Court, Gurgaon does not require any interference by this Court at this stage.

The petition stands dismissed.
