Mr.Vishavjeet Singh Rishi, - complainant in person. JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Section 439 of the Code of Criminal Procedure, seeking regular bail in FIR No.210 dated 17.8.2019, under Sections 419, 420, 465, 467, 468, 471, 448 and 120-B IPC, registered at Police Station, City Moga, District Mota. FIR in the present case was lodged on the allegations of

impersonation and consequent registration of the sale deed. Learned counsel for the petitioner has submitted that the complainant party and the accused have amicably resolved their differences and that the property is to be reverted back to the complainant as per compromise. It has been further submitted that offences are triable by Magistrate. Learned counsel for the petitioner has also relied upon the orders passed by Coordinate Benches of this Court granting bail to other coaccused vide Annexure P3 and Annexure P4. He has also submitted that the main accused in the present case namely Gurpreet Singh has been granted bail by this Court vide Annexure P4.

Mr.Vishavjeet Singh Rishi, who is complainant and has appeared in person through video conference has stated that the parties have amicably resolved their differences to the satisfaction of the complainant and that the complainant has no complaint against the petitioner subject to his fulfilling conditions of compromise.

I have heard the learned counsel for the parties through video conference.

In view of the stand taken by the complainant who has appeared in person through video conference that the matter has been amicably settled, without adverting to the merits of the case, I deem it fit and appropriate to admit the petitioner on bail. The present petition is allowed. It is ordered that the petitioner shall be released on bail on furnishing bail bond/surety bond to the satisfaction of the concerned trial Court/Duty Magistrate.

However, anything observed hereinabove shall not be treated as an expression of opinion on merits of the case and is meant only for the purpose of decision of present petition. September 28, 2020.
